Summary Divorce

In certain states, a summary divorce (also known as a simple divorce) may be a viable option. In a summary divorce or dissolution process, the entire divorce process is much simpler, and in most cases much faster.
Here are some of the factors that make the summary divorce such a quick process:
- Less Paperwork: this includes any court filings in addition to any written agreements
- Fewer Court Appearances
- Not as much negotiations between the two parties
In order to be able to file for a summary divorce, certain eligibility requirements must be met. Here are some requirements that are general to most states:
- The marriage must have been short, usually under 5 years
- There were no minor children in the marriage
- There is a minimal amount of real property (i.e. mortgage)
- The total marital property is within a certain threshold, which is usually aroung $35,000
- Each party’s own personal property is within a threshold, which usually equals the marital property threshold
