  • Collaborative divorce falls under the larger umbrella known as collaborative law. Other terms for this include collaborative practice and collaborative family law. Basically, it is an agreement that both parties will not go (or threaten to go) to court.

    The goal in the collaborative divorce process it to have a fair settlement through several meetings with both parties and their divorce lawyers. In some cases neutral experts attend the joint sessions as well. In the collaborative divorce meetings, the goals, needs, priorities, and interests of each spouse are addressed. After the series of joint sessions, each party then makes their own decisions about the divorce.

    In many cases, collaborative divorce is a much better option than using mediation. The primary reason for this is that divorce attorneys are present to inform about the state divorce laws and the consequences of the various options.
